HostBoom Terms of Service

Welcome to HostBoom. These Terms of Service ("Terms") govern your use of all HostBoom products and services including Shared Hosting, VPS Hosting, Dedicated Servers, Domains, SSL Certificates, Business Email, Website Migration, DNS Services, Cloud Hosting and any related services offered by HostBoom.

By creating an account, purchasing a service, or using any HostBoom service, you agree to these Terms of Service.

1. Acceptance of Terms

By accessing or using our website or services, you agree to comply with these Terms, our Privacy Policy, Refund Policy, Acceptable Use Policy (AUP), and any other published policies.

2. Eligibility

• You must be at least 18 years old or legally capable of entering into a binding agreement.
• You must provide accurate registration information.
• You are responsible for maintaining the confidentiality of your account credentials.

3. Services

HostBoom may provide the following services:

• Shared Hosting
• VPS Hosting
• Dedicated Servers
• Cloud Hosting
• Domain Registration & Transfer
• Business Email Hosting
• SSL Certificates
• Website Migration
• DNS Management
• Backup Services
• Additional Hosting Solutions

4. Account Registration

• Customers must provide accurate information.
• False information may result in suspension.
• You are responsible for all activities under your account.
• Identity verification may be requested where required.

5. Billing & Payments

• Invoices must be paid before the due date.
• Late payment may result in suspension.
• Prices may change upon renewal.
• Applicable GST will be charged as per Indian law.

6. Automatic Renewal

Eligible services may renew automatically unless cancelled before the renewal date.

7. Domain Registration

• Domain registrations are subject to registry rules.
• Domain availability cannot be guaranteed.
• Domain registration fees are generally non-refundable.

8. Customer Responsibilities

• Maintain secure passwords.
• Keep software updated.
• Maintain independent backups.
• Use services only for lawful purposes.
• Respond to abuse notices promptly.

9. Acceptable Use Policy

The following activities are strictly prohibited:

• Spam
• Phishing
• Malware Distribution
• Virus Hosting
• Botnets
• DDoS Attacks
• Unauthorized System Access
• Identity Theft
• Fraud
• Illegal Gambling
• Child Exploitation Material
• Copyright Infringement
• Trademark Infringement
• Hosting Illegal Content
• Any activity prohibited under Indian law

10. Resource Usage

Shared Hosting customers must not excessively consume CPU, RAM, Disk I/O, or other shared resources that negatively affect server performance.

11. VPS & Dedicated Servers

• Customers are responsible for server administration unless a managed plan is purchased.
• Customers must maintain server security and updates.
• Customers are responsible for installed software.

12. Email Services

Email services must not be used for:

• Spam
• Bulk Unsolicited Email
• Email Spoofing
• Phishing Campaigns

13. SSL Certificates

HostBoom may offer free or paid SSL certificates. Third-party SSL services remain subject to the issuing Certificate Authority's policies.

14. Website Backups

Customers are solely responsible for maintaining their own backups. HostBoom may provide backups on a best-effort basis unless otherwise specified.

15. Suspension

HostBoom may suspend services without prior notice for security threats, abuse, malware, fraud, non-payment, or violations of these Terms.

16. Termination

Accounts may be permanently terminated for repeated policy violations, fraudulent activities, illegal use, or failure to complete verification.

17. Refund Policy

Refund eligibility is governed solely by the HostBoom Refund Policy. Certain products including domains, SSL certificates, software licenses, and third-party products are non-refundable.

18. Intellectual Property

All HostBoom logos, trademarks, branding, website content, and software remain the intellectual property of HostBoom or its licensors.

19. Privacy

HostBoom processes customer information in accordance with its Privacy Policy and applicable Indian data protection laws.

20. Third-Party Services

HostBoom is not responsible for outages or policy changes made by third-party providers.

21. Security

Customers must not attempt to exploit vulnerabilities, scan other customers' systems, or interfere with HostBoom infrastructure.

22. Limitation of Liability

To the maximum extent permitted by law, HostBoom shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of data, revenue, profits, or business interruption.

23. Indemnification

You agree to indemnify and hold HostBoom harmless from any claims, damages, liabilities, costs, or expenses arising from your use of our services or your violation of these Terms.

24. Force Majeure

HostBoom shall not be liable for delays or failures caused by natural disasters, war, internet outages, cyber attacks, government actions, strikes, or other events beyond reasonable control.

25. Changes to Terms

HostBoom may update these Terms from time to time. Continued use of our services after such changes constitutes acceptance of the updated Terms.

26. Governing Law

These Terms shall be governed by the laws of the Republic of India.

27. Jurisdiction

All disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts located at Jamkhed, District Ahmednagar (Ahilyanagar), Maharashtra, India.
